End-User License Agreement
This End-User License Agreement governs your use of the RackViz desktop applications, web version, and associated documentation. By installing, accessing, or using RackViz, you agree to this agreement.

If you do not agree to all terms of this EULA, do not install, access, use, or copy the Software.
1. Summary
You must agree to all terms of this EULA to use RackViz.
RackViz offers a free tier and paid tiers that unlock additional features.
The software may communicate with RackViz servers for updates, error reports, license verification, and anonymized usage data. You may opt out of anonymized usage data where supported.
RackViz is provided on an “as is” basis with no warranties.

2. The Agreement
This End-User License Agreement is a legal agreement between you, either as an individual or on behalf of an entity, and RackViz LLC regarding your use of RackViz desktop applications, web version, and associated documentation, collectively referred to as the Software.
By downloading, installing, accessing, using, or copying the Software, you accept and agree to be bound by this EULA.
If you do not agree to all terms of this EULA, do not install, access, use, or copy the Software.
3. The License
This EULA allows you to install and use the free tier of the Software for any lawful purpose consistent with this EULA, whether through the desktop application or web version.
Paid tiers, including premium features, one-time purchases, or subscriptions, provide access to additional or enhanced functionality as described on the pricing page.
Your right to use paid features is conditioned on payment of applicable fees and continued compliance with this EULA.
The Software and all paid features are licensed, not sold. RackViz LLC reserves all rights not expressly granted to you.
4. Purchases and Payment Terms
Certain features or access levels require payment of a one-time fee or recurring subscription.
Subscriptions automatically renew at the end of each billing period unless canceled. You authorize RackViz LLC or its payment processor to charge your payment method on a recurring basis.
You may cancel anytime through the billing portal or another method provided by RackViz. Cancellation takes effect at the end of the current billing period unless otherwise stated.
All purchases are final and non-refundable except where required by law. Refund requests are handled at RackViz LLC’s discretion and should typically be made within 14 days of purchase.
Prices may change with notice. Failure to pay applicable fees may result in suspension or termination of access to paid features.
5. Restrictions
You must use the Software in compliance with all applicable laws in the jurisdictions where you access or use it.
You may not sell, resell, rent, lease, or exchange the Software or any paid content for value.
You may redistribute the free desktop installer only if it includes this EULA and is not repackaged or bundled with other software.
Redistribution of the web version, paid content, license keys, or paid features is strictly prohibited.
You may not remove or alter proprietary notices, marks, or branding in the Software.
You may not circumvent, disable, or interfere with license activation, subscription enforcement, feature locking, authentication, or access controls.
For the web version, you may not use automated tools, bots, scrapers, or similar methods to access the service beyond normal browser use. You may not attempt to download or extract the web application code for offline use unless expressly permitted.
6. Privacy Notices
The Software may automatically communicate with RackViz servers for updates, error reports, license verification, and anonymized usage data.
For details about how information is collected and used, please review the RackViz Privacy Policy at rackviz.com/privacy.
You may opt out of anonymized usage data where supported. Automatic updates, license checks, and error reports may be required for the Software to function properly.
If you do not want these features, you must uninstall the desktop application and stop accessing the web version.
7. Open-Source Notices
Certain components of the Software may be subject to open-source licenses.
Applicable open-source license texts may be included in the documentation or related notices.
If there is a conflict between this EULA and an applicable open-source license, the open-source license terms control for that component.
8. Intellectual Property
The Software and all worldwide copyrights, trade secrets, trademarks, and other intellectual property rights in the Software are the exclusive property of RackViz LLC or its licensors.
RackViz LLC reserves all rights not expressly granted in this EULA.
Nothing in this EULA transfers ownership of RackViz intellectual property to you.
9. Third-Party Trademarks
The Software may contain or reference names, logos, trademarks, service marks, product designs, or other intellectual property belonging to third parties.
These references are used solely for identification, compatibility visualization, and informational purposes.
All third-party marks remain the property of their respective owners. RackViz LLC does not claim ownership of any third-party marks.
Unless expressly stated, RackViz LLC is not affiliated with, sponsored by, endorsed by, authorized by, or partnered with any third-party trademark owner.

10. Disclaimers and Limitations on Liability
The Software is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied.
RackViz LLC does not warrant that the Software will meet your requirements, operate without interruption, be error-free, or that defects will be corrected.
To the maximum extent permitted by law, RackViz LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, goodwill, or business interruption.
RackViz LLC may modify, suspend, or discontinue the Software or any paid content at any time, with or without notice.
11. Termination
This EULA terminates automatically if you fail to comply with any term.
For paid subscriptions, access ends at the conclusion of the current billing period upon cancellation, unless access is terminated earlier due to breach.
Upon termination, you must stop using the Software, including desktop and web versions, and destroy all copies in your possession.
12. General
This EULA constitutes the entire agreement between you and RackViz LLC regarding the Software.
This EULA is governed by the laws of Oklahoma, without regard to conflict of law principles.
If any provision of this EULA is held invalid or unenforceable, the remaining provisions will continue in full force and effect.
